Welcome to Aloalii Cultural Resource Center & Marketplace (“Aloalii,” “we,” “us,” or “our”). We operate this online store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”), to provide our customers with access to our products and marketplace.

Aloalii is powered by Shopify, which provides the technology that enables us to operate our online store and provide the Services to you.

These Terms of Service (“Terms”), together with our Privacy Policy, Return/Refund Policy, Shipping Policy, and any other policies referenced in these Terms, describe the terms and conditions that apply when you access or use our Services or purchase products from us.

Please read these Terms carefully. By accessing, browsing, or using our Services, or by placing an order with us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services or place an order.

When you place an order through our Services, you are submitting a request to purchase the products in your order. Aloalii reserves the right to accept, decline, or cancel an order for legitimate reasons, including product availability, pricing or listing errors, suspected fraudulent activity, or other circumstances affecting the transaction.

Your order is not considered accepted until we have processed the order and provided an order confirmation.

If we are unable to accept, modify, or cancel an order, we will make reasonable efforts to notify you using the contact information provided with your order.

Please review your order carefully before submitting it. Depending on the status of your order, we may not be able to accommodate cancellation requests after an order has been accepted or prepared for shipment.

Returns, refunds, and exchanges are governed by our Return/Refund Policy, which is incorporated into these Terms by reference.

Wholesale and Business Purchases

Aloalii may offer wholesale or other business-to-business purchasing opportunities.

Wholesale orders may be subject to separate pricing, minimum order quantities, payment requirements, shipping terms, purchase limits, or other conditions agreed upon between Aloalii and the purchaser.

Unless otherwise agreed in writing, a wholesale purchase is subject to the terms applicable to that specific order.

SECTION 4 — PRICES AND BILLING

Prices, discounts, promotions, and product availability may change at any time without notice.

The price charged for a product will generally be the price displayed at the time the order is placed and will be reflected in your order confirmation, subject to correction of obvious pricing or listing errors.

Unless otherwise stated, prices may not include applicable taxes or shipping charges, which will be displayed during checkout when applicable.

Promotional offers may be subject to additional terms. If the terms of a specific promotion conflict with these Terms, the terms of that promotion will apply to the extent of the conflict.

You agree to provide accurate and complete billing, payment, shipping, and contact information and to update that information when necessary.

You represent that you are authorized to use the payment method provided for your purchase.

SECTION 5 — SHIPPING AND DELIVERY

We currently ship orders within the United States.

Our current processing and shipping information is described in our Shipping Policy, which is incorporated into these Terms by reference.

Please allow the processing time stated in our Shipping Policy before your order is shipped. Shipping and delivery times provided by Aloalii are estimates and are not guaranteed unless expressly stated otherwise.

Once an order has been handed to the shipping carrier, delivery may be affected by circumstances outside our control, including carrier delays, weather, holidays, service interruptions, or other unforeseen circumstances.

If we become aware that an order is unlikely to ship within the timeframe represented to you, we will make reasonable efforts to contact you and address the delay in accordance with applicable law.

You are responsible for providing an accurate and complete shipping address. Aloalii is not responsible for delivery problems resulting from an incorrect or incomplete address provided by the customer.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their contents, including but not limited to text, photographs, graphics, logos, designs, product descriptions, videos, audio, product reviews, and the selection and arrangement of such materials, are owned by Aloalii, its affiliates, licensors, or other applicable rights holders and are protected by applicable intellectual property laws.

You may use the Services for personal, lawful purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit material from the Services without our prior written permission, except as permitted by applicable law.

Nothing in these Terms grants you ownership of or a license to any Aloalii trademark, copyright, design, or other intellectual property except as expressly stated.

The Aloalii name, logos, product names, service names, designs, and slogans are trademarks of Aloalii or their respective owners. You may not use them without prior written permission.

All other trademarks appearing on the Services belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to third-party tools or services as part of our Services.

These tools may be provided by third parties that we do not control or operate. Your use of any third-party tool may be subject to that provider’s own terms and policies.

Where permitted by applicable law, Aloalii is not responsible for the availability, functionality, or performance of third-party tools.

Any new features, tools, or resources that we add to the Services in the future may also be subject to these Terms.

We do not control or guarantee the accuracy, availability, content, products, or services offered by third-party websites.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Aloalii is powered by Shopify, which enables us to provide the Services to you.

However, purchases and sales made through our online store are transactions directly between you and Aloalii. Shopify is not responsible for the products sold by Aloalii or for the terms of transactions between you and Aloalii.

By using our Services, you acknowledge that Shopify and its affiliates are not responsible for claims, damages, or liabilities arising from purchases or transactions between you and Aloalii, to the extent permitted by applicable law.

Because our online store is powered by Shopify, Shopify may also process certain information in connection with your use of the Services. Shopify’s handling of information is subject to Shopify’s applicable policies.

SECTION 11 — FEEDBACK AND REVIEWS

If you submit reviews, comments, suggestions, ideas, photographs, or other content to Aloalii (“Feedback”), you grant Aloalii a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, and distribute that Feedback in connection with operating, improving, and promoting our Services, subject to applicable law.

You represent that you have the necessary rights to submit the Feedback and that your Feedback does not violate the rights of another person or entity.

You should not submit confidential information that you do not want us to use in accordance with these Terms.

We may remove or decline to publish Feedback that we reasonably believe violates these Terms, applicable law, or the rights of others.

You remain responsible for the content of your Feedback.

This may include, where permitted by law, loss of profits, loss of revenue, loss of data, business interruption, or replacement costs.

Our liability will not be limited or excluded to the extent that applicable law does not permit such a limitation or exclusion.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

  4. Your misuse of the Services.

This obligation does not apply to the extent that a claim results from Aloalii’s own unlawful conduct or from circumstances where indemnification is prohibited by applicable law.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the remaining provisions will remain in full force and effect.

SECTION 20 — WAIVER; ENTIRE AGREEMENT

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

These Terms, together with the policies and documents expressly incorporated by reference, constitute the agreement between you and Aloalii regarding your use of the Services and purchases made through our store.

These Terms replace prior versions of the Terms of Service relating to the Services.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
